Notice requirements (17 U.S.C. § 512(c)(3))
A valid notice must include:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and its location (URL).
- Your contact information (name, address, phone, email).
- A statement, made in good faith, that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the copyright owner's behalf.
Notices missing required elements may be invalid. Knowingly filing a false notice can result in liability under 17 U.S.C. § 512(f).
Counter-notice procedure
If you believe content was removed by mistake or misidentification, you may submit a counter-notice including:
- Your physical or electronic signature.
- Identification of the material removed and its prior location.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, phone number, and consent to the jurisdiction of the federal court in your district (or, if outside the US, in Utah).
- A statement that you will accept service of process from the original notifier.
Repeat infringers
We may suspend or terminate accounts that we determine, in our discretion, to be repeat infringers.
